HIPAA compliant marketing for dentists and cosmetic dentists
Updated October 16, 2026
Dental marketing runs on reviews, recall texts, new-patient offers and online booking. Dental practices that bill insurance electronically are HIPAA covered entities, so a review reply or a website tool can become a federal privacy problem.
Where the risk shows up
- Review replies that mention treatment, insurance or cost details
- Recall and reminder lists reused for promotional texts without marketing consent
- Pixels on online booking and new-patient forms
- Smile makeover photos and patient stories posted without written authorization
- Reviews collected with incentives or posted by staff without disclosure
What the record shows
HIPAA applies to covered entities, which include health care providers that conduct certain transactions electronically, such as billing health plans (HHS).
In 2022, New Vision Dental in California paid $23,000 to the Department of Health and Human Services Office for Civil Rights after its Yelp replies disclosed patients’ names, treatment and insurance details (HIPAA Journal).
In 2019, Elite Dental Associates in Dallas paid $10,000 after responding to social media reviews with a patient’s surname, treatment plan, insurance and cost information (Thomson Reuters).
The Federal Trade Commission’s consumer reviews and testimonials rule, effective October 21, 2024, allows penalties of up to $51,744 per violation for fake testimonials, paid positive reviews and undisclosed insider reviews (Morgan Lewis).
